These terms govern the supply of the Real View Construction camera and timelapse service (the “Service”) by Real View (“we”, “us”) to the customer named on the order (“you”). By placing an order or using the Service you agree to these terms. Please read them carefully.

1. About us

2. The Service

The Service consists of some or all of the following, as set out in your order:

We may improve or change how the Service works from time to time, provided the changes do not materially reduce the Service you have paid for.

3. Quotes, orders and term

A quote is not an offer and we may withdraw or revise it before you accept. A contract is formed when we confirm your order in writing. Unless your order says otherwise, each camera is supplied on a minimum term of twelve (12) months or the length of your project, whichever your order specifies. After the minimum term the Service continues on a rolling basis until cancelled in line with clause 12.

If the site is not ready or access is not available at the agreed time, we may charge a reasonable fee for an abortive or repeat visit.

6. Equipment

Unless your order states that you are buying the equipment outright, all cameras and related hardware remain our property. You must not move, alter, tamper with or allow anyone else to interfere with the equipment. You are responsible for reasonable care of the equipment while it is on your site, and for loss or damage caused other than by fair wear and tear or our own faulty equipment. On termination we will arrange to recover our equipment, and you agree to give us access to do so.

7. Live views and availability

We aim to keep the Service running reliably but we do not guarantee uninterrupted or error-free live streaming. The Service depends on your site’s power and internet connection, on third-party networks, and on hosting providers, none of which we fully control. If the connection drops, the cameras are designed to hold captured images locally and upload them when the connection returns, so a temporary outage should not lose your progress images. We may occasionally suspend the Service for maintenance and will try to give reasonable notice where practical.

8. Footage, films and intellectual property

Subject to you having paid the charges due, we grant you a licence to use the timelapse and cinematic films you produce through the Service for your own purposes, including marketing, PR, tenders and investor materials. The Real View platform, software, branding and the way our films are produced remain our intellectual property.

Unless you tell us otherwise in writing, we may use footage and films from your project in our own marketing and as reference examples of our work. If your order is on a “founding site” or discounted basis, permission to use the finished film as a reference is a condition of that rate.

9. Data protection and people on site

Our handling of personal data is described in our Privacy Policy. Cameras on a live site may capture images of workers, visitors and members of the public. Where you determine why and how that footage is used, you are the data controller for it and we act as your processor; in that case you are responsible for displaying appropriate signage, informing people that recording takes place, and having a lawful basis for it. Each party agrees to comply with applicable data protection law.

10. Liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that:

The Service is provided to businesses; consumer rights that cannot be excluded are unaffected.

11. Confidentiality

Each party will keep confidential any non-public information it receives from the other and use it only to perform its obligations under these terms.

12. Termination and suspension

Either party may end the contract at the end of the minimum term, or afterwards, by giving 30 days’ written notice. Either party may end the contract immediately if the other commits a serious breach that is not put right within a reasonable time, or becomes insolvent. On termination, charges accrued up to the end date remain payable, access to live views and video production ends, and we will arrange to recover our equipment. You should download any films you wish to keep before the contract ends.

13. Events outside our control

We are not responsible for failure or delay in performing the Service caused by events outside our reasonable control, including power or network failures, extreme weather, acts of third parties, or interruption to hosting or connectivity services.

These terms are governed by the law of England and Wales, and disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
